Before investing, it's essential to understand the tax implications of these investments. As a French tax resident, your earnings (interest income) will be taxed in France, but may also be subject to withholding tax in Spain. Fortunately, the tax treaty between France and Spain makes it possible to avoid this double taxation; all you need to do is provide proof that you are a French resident. Let's take a closer look at how this tax system works and how to avoid double taxation.

1. How is property crowdfunding income taxed in Spain?

When you invest in a project via a real estate crowdfunding platform, the interest you receive is subject to tax deductions. . As a French tax resident investing in a Spanish project, interest is subject to :

  • A 19% withholding tax by the Spanish tax authorities if the issuing company is Spanish.
  • Withholding by the French tax authorities, equivalent to 30% of the interest received if you are subject to the single-rate withholding tax (prélèvement forfaitaire unique or PFU) , with the following exceptions exceptions (tax-exempt or cross-border residents).

 

2. How to avoid double taxation

La convention fiscale entre la France et l’Espagne permet d’éviter une double imposition. Pour cela, il vous sera simplement demandé de prouver que vous résidez en France. Tant que le certificat de résidence fiscale française ne nous est pas transmis, les débits de votre compte Raizers seront bloqués jusqu’au versement des intérêts de l’opération espagnole et un prélèvement de 19% sera effectué en plus de la flat tax au moment du versement de ces intérêts, avant le déblocage de vos débits.

A. For individuals

To do this, you'll need to have a certificate of tax residence validated by the tax authorities. This is form n°731 if you are investing as an individual. You'll need to fill it in and send it to the tax authorities via the secure messaging system on the impôts.gouv.fr website, who will return the signed document to you, which you'll then need to send to Raizers.

This document must be renewed every year for as long as you have investments in Spanish operations.

You can find this certificate on the My taxation page of your personal space. A message will appear in your personal space when it is necessary to provide Raizers with the certificate.

To fill it in, you will need to provide the following information:

  • Your full name, profession and complete home address.
  • Tick the box "Application of a tax treaty for the application of the treaty rate".
  • Tax treaty between France and: Spain
  • Tick the Interest box for the type of income
  • All other fields must be left blank

Once these steps have been taken, you will automatically be exempt from Spanish withholding tax, and will be subject only to your usual French tax regime.

B. For companies

The tax residence certificate for legal entities (French form n°730-FR-ES) can be accessed directly from the legal entity's tax account:

  • Go to your impots.gouv.fr account
  • Go to "Tax Account
  • Go to "Attestation Fiscale
  • You will then need to fill in the following information:
    • Language preference: SPANISH
    • Year of income: 2025
    • State party to the tax treaty: Spain
    • Type of income: check " Interest
    • All other fields must be left blank.
  • As soon as you receive the certificate, you must send it to Raizers via the page My supporting documents page of your Raizers personal space.

Once this certificate has been obtained and sent to Raizers, your income from this investment will not be taxed at source in Spain.

This document must be renewed every year for as long as you have investments in Spanish operations.
