Leases are rental contracts between an owner (the lessor) and a tenant (the lessee). There are several different types of lease, each designed to meet specific needs. Here's an overview of the main types of leases:

Residential lease

The residential lease is a rental contract for a dwelling intended for residential use. This type of lease is governed by specific regulations, the law of July 6, 1989. Residential leases must be concluded for a minimum term of 3 years, with certain exceptions (for example, if the lessor is a legal entity). The tenant benefits from certain protections, such as a rent ceiling, the possibility of renewing the lease, and a security deposit guarantee.

Commercial lease

The commercial lease is a rental contract for commercial premises. Unlike residential leases, commercial leases are not subject to specific regulations, but are governed by the French Commercial Code. Commercial leases must be signed for a minimum of 9 years, with certain exceptions. The tenant may renew the lease, but the lessor may refuse under certain conditions. Rent is set freely between the parties.

The professional lease

The professional lease is a rental contract for premises used by a liberal profession or sole proprietorship. Professional leases are not subject to any specific regulations, but are governed by the French Civil Code. Professional leases must be concluded for a minimum term of 6 years, with certain exceptions. The tenant may terminate the lease at any time, subject to 6 months' notice. Rent is set freely between the parties.

Rural lease

The rural lease is a rental contract for farmland or farm buildings. Rural leases are governed by specific regulations set out in the French Rural and Maritime Fishing Code. A rural lease must be concluded for a minimum of 9 years, with certain exceptions. The tenant has the option of renewing the lease, as well as a right of pre-emption in the event of sale of the property. Rent is set according to local custom and the characteristics of the leased property.

Other types of lease

There are other types of rental leases, less common than residential, commercial, professional and rural leases. Here are a few examples:

  • Emphyteutic lease: this is a long-term rental contract (up to 99 years) which allows a lessee to benefit from the use of a property (land, building) in exchange for an annual rent.
  • Construction lease: this is a rental contract that allows a lessee to construct a building on land belonging to the lessor. Construction leases are concluded for a minimum term of 18 years. At the end of the lease, the lessee must leave the building to the lessor, unless otherwise agreed.

In conclusion, rental leases are rental contracts that allow an owner to rent a property property to a tenant for a fixed term. The different types of lease meet specific needs and are governed by different regulations. It is important to find out about the characteristics of each type of lease before entering into one.
